Industrial property: increase in fees applicable when administrative formalities are completed

Sovereign Orders no. 10.443 and no. 10.444 of 6 March 2024 (JDM n° 8686 of 15 March 2024) increased the amounts of the fees applicable (from €5 to €20 ) on completion of administrative formalities in industrial property matters, set by Sovereign Order no. 6.722 of 26 December 2017, as follows:

1. PATENTS

¤ Amount of the fee for drawing up the search report (effective from 1st January 2024):

• €2,468 (instead of €2,336)

¤ Amount of the annual instalments (effective from 1st April 2024):

• The first €1 (unchanged)
• The second €30 (unchanged)
• The third €55 (instead of €50)
• The fourth €60 (instead of €55)
• The fifth €100 (instead of €95)
• The sixth €135 (instead of 130 €)
• The seventh €150 (instead of €145)
• The eighth €160 (instead of €150)
• The ninth €175 (instead of €165)
• The tenth €195 (instead of €185)
• The eleventh €240 (instead of €230 )
• The twelfth €285 (instead of €270)
• The thirteenth €320 (instead of €305)
• Fourteenth €365 (instead of €350)
• The fifteenth €390 (instead of €370)
• The sixteenth €405 (instead of €385)

2. DESIGNS & MODELS

• Filing a design application: €35 (instead of €30)
• Protection per design: €20 (instead of €15)
• Protection per object: €100 (unchanged)
• Extension of design protection: €20 (instead of €15)
• Extension of protection per object: €100 (unchanged)
• Surcharge for late payment of the extension: 50% of the corresponding fee due (unchanged)
• Special "Soleau" envelope: €18 (unchanged)
• Reproduction of any document per page: €2 (unchanged)

¤ Special register (effective from 1st April 2024):

• Application for registration, per title: €35 (instead of €30)
• Statement of entries, per title: €20 (unchanged)
• Certificate of identity: €15 (unchanged)

3. TRADEMARKS

¤ Amounts of the fees (effective from 1st April 2024) :

• Filing a trademark application: €120 (instead of €100)
• Renewal application: €180 (instead of €150)
• Surcharge per class of goods or services, beyond three: €35 (instead of €30)
• Surcharge for late renewal: 50% of the corresponding fee due (unchanged)
• Reproduction of any document, per page: €2 (unchanged)
