Monegasque Supplementary Retirement Fund (CMRC): regulatory texts

The regulatory texts (Sovereign Orders and Ministerial Orders) implementing Law no. 1.544 of 20 April 2023 establishing the "Caisse Monégasque de Retraite Complémentaire" (CMRC) were published in the Journal de Monaco no. 8673 of 15 December 2023, no. 8676 of 5 January 2024, no. 8681 of 9 February 2024.

According to the Government, from 1 January 2024, this new scheme will affect around 168,000 employees of the Principality.

Conditions for reconstituting compensated periods of interruption of work for the purpose of validating pension rights

• Ordonnance Souveraine n° 10.366 du 1er février 2024 setting the conditions for reconstituting periods of interruption of work for which compensation is paid with a view to validating said periods of compensation for the purpose of awarding pension points, as provided for by Articles 15 and 16 of Law no. 1.544. Interruptions of work before the age of 65 for the following reasons: 1) illness, accident, maternity, paternity, adoption or invalidity compensated by the Caisse de Compensation des Services Sociaux (CCSS); 2) temporary and involuntary deprivation of employment in the Principality compensated by a) the general contractual scheme, pursuant to Ministerial Orders no. 74-418 of 23 September 1974 and no. 79-508 of 7 December 1979, referred to above b) employers excluded from the provisions of Ministerial Order no. 68-151 of 8 April 1968, amended, referred to above, for their employees affiliated to the CMRC; 3) accidents at work or occupational diseases compensated in application of the above-mentioned laws no. 444 of 16 May 1946, as amended, and no. 636 of 11 January 1958, as amended, and in respect of either temporary total incapacity or permanent incapacity when the rate of the latter exceeds 66.66%.

CMRC retirement point value

• Arrêté Ministériel n° 2023-786 du 27 décembre 2023 fixant la valeur du point-retraite de la Caisse Monégasque de Retraite Complémentaire pour l'exercice 2024. From 1 January 2024, the value of the CMRC retirement point is set at €1.496 for the 2024 financial year (revalued on 1 October each year). By way of comparison, the service value of the (French) Agirc-Arrco 2024 point has been set at €1.4159 since 1 November 2023, the annual revaluation date (4.9% increase).

Monthly value of CMRC bonus point

• Arrêté Ministériel n° 2023-787 du 27 décembre 2023 fixant la valeur mensuelle du point de bonification de la Caisse Monégasque de Retraite Complémentaire pour l'exercice 2024. From 1 January 2024, the monthly value of the CMRC bonus point is €0.006675 for the 2024 financial year. The bonus benefit concerns holders of a direct, reversionary or orphan's pension paid by the Caisse Autonome des Retraites (CAR) who, on 1 January 2024, receive a supplementary pension paid by (French) AGIRC-ARRCO. The purpose of this benefit is to allow the beneficiary to benefit from any positive difference between the value of the retirement point paid by the CAR and the service value of the retirement point paid by AGIRC-ARRCO.

Rules applicable to CMRC's financial and accounting operations

• Ordonnance Souveraine n° 10.260 du 7 décembre 2023 portant modification de l'Ordonnance Souveraine n° 7.191 du 31 août 1981 relative aux règles applicables aux opérations financières et comptables de la Caisse de Compensation des Services Sociaux, de la Caisse Autonome des Retraites et de la Caisse Autonome des Retraites des Travailleurs Indépendants.

Persons excluded from the scope of the CMRC

• Arrêté Ministériel n° 2023-726 du 7 décembre 2023 portant application de l'article 1er de la loi n° 1.544 du 20 avril 2023 instituant une Caisse Monégasque de Retraite Complémentaire (employers who have set up a specific scheme to provide supplementary pension benefits for their employees; foundations, associations, international organisations and any other bodies for their staff employed under public law contracts).

Bonus benefit, compensatory allowance and return of contributions

• Ordonnance Souveraine n° 10.257 du 7 décembre 2023 relative à la prestation de bonification, à l'allocation compensatoire et au remboursement des cotisations institués par la loi n° 1.544 du 20 avril 2023 instituant une Caisse Monégasque de Retraite Complémentaire (bonuses are additional quarters added to the years of actual service in order to increase the amount of the pension; the compensatory allowance is available to persons who are not entitled to the payment of a retirement pension provided by the "Caisse Autonome des Retraites" (CAR) due to the length of contribution under the conditions; persons who do not meet, at the age provided for in the first paragraph of article 8 of the said law, the conditions referred to in article 9 of Law no. 1. 544 of 20 April 2023 entitling them to a supplementary retirement pension from the CMRC, may claim reimbursement of the contributions generating entitlement).

Early supplementary retirement with concurrent employment
