The protection of personal data in Monaco is guaranteed by Law no. 1.165 of 23 December 1993 on the protection of "informations nominatives". It has been amended three times (Laws no. 1.353 of 4 December 2008, no. 1.383 of 2 August 2011 on the Digital Economy, no. 1.420 of 1 December 2015). The initial aim was to protect citizens against possible abuses by the administration and possible "plugging".

With the development of new technologies and new commercial practices (data transfers via the Internet, data marketing, e-commerce), the original system has been strengthened to protect data subjects from processing carried out by companies.

The Principality also had to comply with Council of Europe Convention 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data and its Additional Protocol on supervisory authorities and transborder data flows (in force in Monaco since 1 April 2009).

The latest reform involves a major overhaul of Chapter III of Law no. 1.165, relating to monitoring the lawfulness of processing (rewriting of articles 18 and 19, new articles 18-1 and 18-2).

NB : In 2024, a reform of the legislation on protection of personal data is planned
